Refund & Cancellation Policy

- THIS REFUND & CANCELLATION POLICY
1.1 Our Commitment
Tian Tasty Homemade Inc., operating as “Iranyo”, and its representatives, subsidiaries and affiliates (collectively, “Iranyo”, “we”, “us” or “our”), are committed to ensuring fair, transparent, and consistent practices in the handling of cancellations, refunds, chargebacks, and all related financial transactions between Customers and Cooks.
This Refund & Cancellation Policy (the “Policy”) is intended to comply with:
(a) the Ontario Consumer Protection Act, 2002 and other applicable provincial consumer protection laws;
(b) applicable provincial consumer rights legislation;
(c) the Personal Information Protection and Electronic Documents Act (PIPEDA) to the extent applicable to personal data in the context of refunds; and
(d) all other relevant federal and provincial laws governing online commerce, payment processing, and sales tax administration in Canada (collectively, “Applicable Laws”).
No Waiver of Statutory Rights: Nothing in this Policy limits any non-waivable statutory rights under applicable Consumer Laws.
This Policy forms part of, and is expressly incorporated into, the Iranyo Terms of Service (the “Agreement”). In case of any conflict between this Policy and the Agreement, the terms of this Policy shall prevail in respect of cancellations, refunds, and related matters.
1.2 Scope
This Policy applies to:
(a) all orders placed by Customers via the Iranyo platform (the “Platform”);
(b) all orders accepted by Cooks via the Platform;
(c) any payment transaction processed via Stripe, our designated payment processor;
(d) any request for refund, cancellation, or chargeback in relation to a transaction processed via the Platform;
(e) all applicable sales taxes (HST/GST/PST) collected, remitted, or refunded in connection with such transactions.
This Policy applies regardless of the Customer’s method of access (website, mobile browser, or any other interface), and regardless of the Cook’s method of fulfilment (pickup, delivery, or third-party courier).
1.3 Updates
Iranyo reserves the right to amend, modify, or replace this Policy at any time, for any reason, effective upon posting the updated version through the Platform. The “Last Updated” date at the top of this Policy will reflect the latest changes. If modifications are significant, we will provide notice to Users by email or other reasonable means. Continued use of the Platform after the effective date of changes constitutes acceptance of the updated Policy.
- CUSTOMER CANCELLATIONS AND REFUNDS
2.1 General Refund Policy
Iranyo strives to ensure that all orders placed through the Platform meet the highest standards of quality and accuracy. Refunds will be assessed on a case-by-case basis and may be issued as a full or partial refund, or as a credit toward a future purchase, at Iranyo’s sole discretion and in accordance with this Policy.
2.2 Refund Eligibility
Refunds may be considered in the following circumstances:
- The order received is defective, spoiled, unsafe for consumption, or does not comply with applicable food safety standards;
- Items are missing from the order;
- The order contains incorrect items not matching the purchase details;
- The order arrives beyond a reasonable delivery window and is no longer fit for consumption.
2.3 Evidence Required
The Customer must submit a refund request within forty-eight (48) hours of delivery or scheduled pickup and must provide clear and sufficient evidence supporting the claim (e.g., photographs of the food and packaging, the order number, and a detailed description of the issue). Failure to provide such evidence within the stated timeframe will automatically result in the rejection of the refund request. If the evidence provided is incomplete, unclear, or insufficient, Iranyo reserves the right to deny the refund request in its sole discretion.
2.4 Courier Misdelivery/Damage
Where non-delivery, delay, spillage, or damage is attributable to a third-party courier selected through the Platform, Iranyo may, in its sole discretion, issue a full or partial refund to the Customer and will seek recovery from the responsible delivery provider.
For clarity, title and risk of loss passes to the Customer once an order is picked up or handed to a third-party courier. Iranyo shall not be liable for courier actions except in cases of negligence or error directly attributable to Iranyo.
2.5 Duplicate Orders, Payment Errors, and Cook’s Liability for Food Safety
If a Customer is charged more than once for the same order due to a technical error:
- Iranyo will issue a full refund for the duplicate charge;
- Refund processing will follow the same timelines as Section 2.1.
Home Cooks
Each Cook using the Platform from a home kitchen is solely and permanently responsible for the quality, safety, and compliance of the food they prepare and sell through the Platform. While Iranyo strongly recommends that home cooks obtain and maintain valid Commercial General Liability (CGL) or product liability insurance, such coverage is not mandatory.
Commercial Kitchens
Cooks operating from commercial or industrial kitchens are required to obtain and maintain, at their own cost and expense, valid and current Commercial General Liability (CGL) insurance and product liability insurance, with a minimum coverage of $1,000,000 CAD. Proof of insurance must be provided to Iranyo upon request. Failure to maintain required insurance shall result in immediate suspension or termination of the Cook’s account.
General Acknowledgment
Cooks who do not maintain insurance (in cases where it is not mandatory) expressly and irrevocably acknowledge and agree that they bear full and permanent responsibility for all risks associated with their operations, including but not limited to any claims of foodborne illness, injury, or damages.
This clause applies in addition to any other provisions of this Policy, and in no way limits or reduces the Customer’s rights to refunds under Sections 2.1–2.4.
- CANCELLATIONS BY COOKS
3.1 Cook-Initiated Cancellations
If a Cook cancels an accepted order:
- The Customer will receive a full refund (100%);
- All Stripe transaction fees will be deducted from the Cook’s account balance;
- Repeated cancellations may result in suspension or termination of the Cook’s account.
3.2 Failure to Fulfil Order
If a Cook accepts an order but fails to deliver or make it available for pickup:
- The Customer will receive a full refund;
- The Cook is responsible for all related fees, and the amount will be deducted from their next payout.
- CHARGEBACKS AND PAYMENT DISPUTES
4.1 Encouragement of Direct Resolution
Customers are encouraged to contact Iranyo directly before initiating a chargeback with their bank. Early resolution may prevent additional costs and delays.
4.2 Chargeback Handling
- Upon receipt of a chargeback notification from Stripe, the disputed amount will be placed on hold;
- Iranyo will submit transaction evidence to Stripe and the card-issuing bank;
- Resolution timelines are determined by the bank (typically 30–75 days).
4.3 Chargeback Fee
- A chargeback fee will apply in accordance with the then current rates charged by the applicable card network, issuing bank, and/or payment processor (e.g., Stripe).
- If the chargeback results from a Cook’s failure to fulfil an order, the Cook will be liable for such fee.
- TAX TREATMENT OF REFUNDS
Refunds will include applicable HST/GST/PST originally charged;
Iranyo will adjust its tax remittance to the Canada Revenue Agency and provincial tax authorities as required by law;
If only part of the order is refunded, the associated tax will be refunded proportionately.
- METHOD AND TIMING OF REFUNDS
- All refunds are processed through Stripe to the original payment method;
- Typical processing time: 5–10 business days;
- Iranyo is not responsible for delays caused by the Customer’s bank or card issuer.
- OFFSET RIGHTS
Iranyo is entitled to offset any refunds issued to Customers, chargeback amounts, or Stripe fees from future payouts to Cooks. This right applies regardless of the cause of the refund or chargeback.
- NO WAIVER
Failure by Iranyo to enforce any provision of this Policy does not constitute a waiver of such provision in the future.
- GOVERNING LAW
This Policy shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein.
